Trustee Investment
The Trustee Act 1925 and the Trustee Act 2000 place significant responsibilities on trustees to ensure that the assets within a trust are properly administered and invested.
An important provision of the legislation is that trustees are entitled to obtain and consider appropriate professional advice on how the trust assets should be invested.
Whilst trustees are not obliged to seek such advice, doing so will often be in the best interests of the trust beneficiaries, and - in the worst case scenario - not doing so may leave the trustees open to legal action and personal liability.
Fensham Howes works in collaboration with trustees (professional or lay) to provide ongoing advice and sophisticated bespoke computer modelling analyses to assist in identifying the appropriate strategy for the investment of trust assets.
We are also able to work with solicitors engaged in the negotiation of trust settlements – again employing technical and sophisticated modelling techniques to help determine the potential long-term impact on trust assets of different settlement and investment structures.
